Mental Capacity and Deprivation of Liberty Report

The report was a review of the Mental Capacity Act 2005 and the Deprivation of Liberty Safeguards (DoLS) published on 13th March 2017.

The Law Commission is an indepedent body to keep the law under review and to recommened reform where it is needed.

The report sets out recommendations that the DoLS be repealed as a matter of urgency. It suggests that it needs to be replaced as quickly as possible to make sure the Mental Capacity Act 2005 works effectively. The intention is to replace DoLS with an updated system, currently called the Liberty Protection Safeguards.

The report has been published along with a draft Bill.
