Case Law Update 22 – RF v Secretary of State for Work and Pensions – Regulations limiting payment of PIP mobility component quashed for being discriminatory against people with mental health problems

This is part of our case law series reviewing judgements relating to the implementation of the Children and Families Act 2014.

Each review looks at a specific case and explains the potential implications for parents, local authorities and sector practitioners. The reviews have been produced for us by Barrister Steve Broach.

In this update, the High Court quashed the regulations for Personal Independence Payment (PIP) mobility component which discriminated against people with mental health problems.

LATEST: The Government have announced they will not appeal against this ruling so the High Court’s decision will stand.
