Case Law Update 12 – DAT and BNM v West Berkshire Council – Decision to reduce funding for short breaks quashed

This is part of our case law series reviewing judgements relating to the implementation of the Children and Families Act 2014.

Each review looks at a specific case and explains the potential implications for parents, local authorities and sector practitioners. The reviews have been produced for us by Barrister Steve Broach.

This case was a successful judicial review challenge to a local authority’s decision to reduce funding for short breaks provided by voluntary sector organisations. The judgment shows the importance of local authorities taking into account all relevant statutory duties when making decisions to reduce funding for frontline services.
