Case Law Update 4 – L and P v Warwickshire – Entitlement of disabled children to social care assessments

This is part of our case law series reviewing judgements relating to the implementation of the Children and Families Act 2014.

Each review looks at a specific case and explains the potential implications for parents, local authorities and sector practitioners. The reviews have been produced for us by Barrister Steve Broach.

This update builds on Case Law Review #1, which summarised the judgment in a case in Warwickshire where two disabled children, acting through their mothers, dealt with the consequences of Warwickshire County Council reorganising its social care services for disabled children.

The purpose of this update is to consider in more detail the implications of the Warwickshire judgment on ‘Ground C’, concerning access to social work assessments.
