This resource is a Code of Practice that provides statutory guidance to registered medical practitioners, approved clinicians, managers and staff of providers, and approved mental health professionals. It explains how they should carry out functions under the Mental Health Act in practice in relation to the medical treatment of patients suffering from mental disorder.
The Code has been revised following extensive consultation, collaboration and engagement with service users, carers, professionals, the voluntary sector, providers, commissioners and statutory bodies. It looks at how to use the Act, including the guiding principles, mental disorder definition and human rights and also considers the protecting patients’ rights and autonomy, an assessment, transport and admission to hospital and the additional considerations for specific patients. Also mentioned are care, support and treatment in hospital, leaving hospital and professional responsibilities.
